Each of the terms below shall have the following meaning in these General Terms and Conditions of Sale (GTCS):
These General Terms and Conditions of Sale govern the terms of purchase and use of the paid services offered by the SMS Filter Application (hereinafter referred to as the "Application") published by Gingko Lab.
Access to the Application's features is subject to the subscription of an automatically renewing subscription with a free trial period, or the purchase of a lifetime license via Apple's in-app purchase service.
Any subscription to a paid offer constitutes full and unconditional acceptance of the current GTCS.
Subscription to paid offers is only available through the Application using Apple's integrated payment system.
A product purchased through this system is valid on all devices using the same Apple ID, compatible with the Application, and where the Application's features are accessible on this platform.
Two options are offered:
Without one of these options, the main features of the Application are not accessible.
Subscriptions are automatically renewed at the end of each billing period, unless canceled by the User at least 24 hours before the end of the term. They can be canceled at no charge, either directly from the app settings, or via the device’s Settings (Apple ID > Subscriptions).
In the event of a subscription cancellation:
When available, the free trial allows access to the full features of the Application for a limited time.
At the end of the trial period, the subscription is automatically converted to a paid subscription unless canceled before the end of the trial.
All filtering and blocking features described in the Terms of Use are fully unlocked through either a subscription or a one-time purchase. By choosing one of these options, users gain unlimited access to all functionalities without restriction for the duration of their subscription or permanently in the case of a lifetime purchase.
Subscription and lifetime purchase prices are displayed in dollars ($) or the applicable local currency, inclusive of all taxes and Apple commissions, and are specified on the purchase page. The amount charged for any item sold through the Application corresponds to the price shown at the time of purchase by the User. Depending on the bank, additional taxes or fees may apply; the Publisher has no control over these and disclaims any responsibility. Users are encouraged to consult their bank if they have any questions regarding such charges before making a purchase through the Application.
Prices may change at any time, either by Gingko Lab or by Apple.
For one-time purchases, these changes do not affect purchases already made, and Gingko Lab is not required to notify users.
For subscriptions, Apple is responsible for informing users of any price changes via email and/or notification and may require users' consent depending on the nature of the change.
The Publisher may occasionally offer promotional prices as limited-time offers or incentives for eligible purchases made during the promotional period. Due to the urgent and promotional nature of these offers, we are unable to provide price protection, refunds, or retroactive discounts for previous purchases if a price reduction or promotional offer occurs.
Payments are processed through Apple’s integrated in-app purchase system, which manages the entire transaction and only communicates the transaction status to the Application. No banking information is ever shared with the publisher of the Application. The payment provider may have its own terms and conditions, which we recommend reviewing before completing any transaction. If the transaction is not approved by the provider, the User’s purchase will not be confirmed.
Gingko Lab cannot be held liable for any issues in the execution of the transaction arising from Apple’s payment system or from events classified as force majeure.
According to App Store policies, purchases of digital subscriptions and lifetime offers are final and non-refundable. However, Users may request a refund in certain situations, including but not limited to:
If the User experiences an issue and is unable to access the purchased service, we encourage them to contact Gingko Lab using the in-app contact feature.
Refund requests must be submitted through Apple’s refund request form using the Apple ID associated with the Application download. Refund decisions are made solely by Apple and Gingko Lab has no influence over this process.
Gingko Lab cannot be held liable for any failure to fulfill an order resulting from Apple’s payment system or any event classified as force majeure.
The publisher strives to ensure continuous access to the Application but cannot be held responsible for any interruptions or temporary unavailability, particularly in cases of maintenance or force majeure.
All elements of the Application (texts, logos, images, code, etc.) are protected by intellectual property laws and are the exclusive property of the publisher.
These Terms and Conditions are effective as of April 11, 2025. Gingko Lab reserves the right to modify all or part of the Terms and Conditions at any time. Users are encouraged to regularly review the Terms and Conditions to stay informed of any changes.
If any part of the Terms and Conditions is found to be illegal, invalid, or unenforceable for any reason, that provision shall be deemed unwritten without affecting the validity of the remaining provisions, which shall continue to apply.
Any claims must be submitted via the contact feature available within the Application.
These Terms and Conditions are governed by French law. In the event of a dispute relating to the formation, execution, or interpretation of the Terms and/or a Subscription, jurisdiction is expressly assigned to the competent courts of Bordeaux, unless an amicable resolution is reached.
